Mediation
Mediation is a voluntary, confidential, non-adversarial way to resolve disputes. A trained, neutral mediator from Tredela CMRC helps the parties communicate and negotiate an agreement they can both accept.
Private mediation
Individuals or groups ask Tredela CMRC to act as the neutral third party who helps them settle a dispute. Once it is settled, the parties may register their agreement in court so that it is respected now and in the future.
Areas we handle
- Land and succession mediation
- Commercial mediation
- Political mediation
- Customary and traditional mediation
Court Annexed Mediation (CAM)
In Court Annexed Mediation, the Judiciary appoints a mediator to help resolve the dispute. Tredela CMRC mentors newly qualified mediators and acts as a consultant to peer mediators.
Where mediation helps
- Commercial and business disputes
- Workplace, labour and HR conflicts
- Family matters such as divorce, child custody, succession and property division
- Contract and personal injury claims
How mediation differs
Court and mediation
- Court
- Formal, public and adversarial. A judge makes a binding ruling: someone wins and someone loses.
- Mediation
- Informal and private, aiming for a collaborative, win-win solution.
Arbitration and mediation
- Arbitration
- An arbitrator hears the facts and imposes a binding decision, like a private judge.
- Mediation
- The mediator never decides. They guide the parties to agree their own terms.
